1. Allgemeine Informationen

2. Vertragsgegenstand
2.1. FYNEST Agency GmbH provides its customers with digital agency services, particularly in the areas of website creation, online store development, marketing strategies, advertisements (Ads), search engine optimization (SEO) and conversion rate optimization (CRO).
3. Vertragsabschluss
3.1. A contract is concluded through written offer confirmation from FYNEST Agency GmbH, which can also be done by email.
3.2. The start of the contract and the provision of services take place after receipt of the agreed payment.
3.3. Unless otherwise agreed, the minimum contract term is 12 months.
3.4. Confirmations and agreements can be made in writing, by email or verbally.
4. Prices and payment terms
4.1. Remuneration for the services is either a flat rate or on an hourly basis, as specified in the respective offer.
4.2. Payments must be made by bank transfer or SEPA direct debit within 7 days of receipt of the invoice.
4.3. In the event of late payment, reminder fees amounting to 3% of the order amount will be charged.
5. Performance period and acceptance
5.1. The service period and the acceptance criteria are specified in the respective offer.
5.2. The customer must accept the services provided according to the criteria agreed in the offer.
6. The client’s obligation to cooperate
6.1. The client undertakes to support FYNEST Agency GmbH in carrying out the services.
6.2. The client must give timely feedback and ensure the necessary availability.
6.3. The client provides all necessary access, information and materials.
7. Liability and warranty
7.1. FYNEST Agency GmbH assumes no liability for damages unless they were caused intentionally or through gross negligence.
7.2. Upon delivery, the project is considered suitable and technically functional.
8. Confidentiality and Data Protection
8.1. FYNEST Agency GmbH undertakes to protect all confidential information of the client and to comply with applicable data protection regulations.
8.2. A detailed data protection declaration in accordance with Articles 13 and 14 GDPR is available on the FYNEST Agency GmbH website.
9. Termination
9.1. The contract term is 12 months.
9.2. In the event of early termination, the remaining amount must be paid for the remaining months.
9.3. The contract will be automatically extended by 12 months after the agreed contract term has expired.
10. Dispute Resolution and Place of Jurisdiction
10.1. The law of the Republic of Austria applies.
10.2. The place of jurisdiction for all disputes arising from this contract is the registered office of FYNEST Agency GmbH.
11. Schlussbestimmungen
11.1. Should a provision of these General Terms and Conditions be or become invalid, the effectiveness of the remaining provisions remains unaffected.
11.2. Changes and additions to these terms and conditions must be made in writing.
